Intellectual Property Policy

Who owns what on Onyatrips, and what you may and may not do with it.

Last updated: 8 August 2026

Effective Date: 8 August 2026
Last Updated: 8 August 2026

This Policy is a user-facing companion to, not a replacement for, the "Intellectual Property & Proprietary Rights Terms" module of the Terms and Conditions, which is the controlling legal document and whose defined terms ("Onyatrips IP," "Marks," "Proprietary Systems," "Content and Works," "Software," "Confidential Information") this Policy adopts and uses consistently. This Policy explains those provisions in more accessible terms and adds detail on User- and business-submitted content licensing, which the Terms and Conditions address primarily in the separate "User-Generated Content Terms" module.

1. Purpose and Scope

This Policy explains who owns what on Onyatrips: our own intellectual property, third-party intellectual property we use under license, and the intellectual property you or a business contribute as User Content. It also explains what you may and may not do with our intellectual property, and how to report suspected infringement. Copyright-specific notice-and-takedown procedure is set out in detail in the separate Copyright Policy; this Policy is the broader ownership-and-licensing framework.

2. Onyatrips' Own Intellectual Property

Consistent with the Terms and Conditions' Intellectual Property & Proprietary Rights Terms module, "Onyatrips IP" means all intellectual property rights, in every jurisdiction, whether registered or unregistered, in: our brand and Marks; our Content and Works; our Software and source code; our Proprietary Systems; our databases and datasets; and our trade secrets and Confidential Information. All Onyatrips IP is owned by, or validly licensed to, Onyatrips Tech Private Limited. Nothing in this Policy or your use of the Platform transfers any Onyatrips IP to you.

3. Our Brand: "Onyatrips" and "Onya"

The name "Onyatrips," our logo, the mascot "Onya," and our taglines and brand identity are our exclusive property (our "Marks"). You must not use, register, or adopt any Mark, or anything confusingly similar to one, without our prior written consent, and you must not use a Mark in a way that suggests an endorsement, affiliation, or partnership that does not exist.

4. Our Proprietary Systems

Our "Proprietary Systems" include our discovery, filtering, and matching logic, our database taxonomy and categories, and — where they exist in the current or a future version of the product — any scoring, ranking, or AI-assisted logic used to power recommendations. As explained in detail in the Responsible AI Policy, the Terms and Conditions describe these systems in AI/ML terms (an "Evaluation Framework," "matching engine," "travel-intelligence" systems) that have not been confirmed to exist in that form in the current product; whether implemented today as deterministic rule-based logic or enhanced with machine learning in the future, these systems and their underlying logic, weightings, and structure are Onyatrips' proprietary trade secrets and Confidential Information, protected regardless of their current technical sophistication.

5. Content, Works, and Software We Own

Our own "Content and Works" — editorial destination content, illustrations, graphics, UI/UX design, and brand copy — and our "Software" — source code, APIs, and technical infrastructure — are original works protected by copyright and other law, and are owned by us or our licensors. You must not copy, adapt, reproduce, or create derivative works from these except as expressly permitted (for example, ordinary, incidental use of the website through your browser as intended) or with our prior written consent.

6. Database and Compilation Rights

Our datasets and databases — including the selection, verification, coordination, and structuring of the data within them — represent substantial investment and are protected as original compilations and, where applicable, by database rights. You must not extract, reuse, or reconstitute a substantial part of any Onyatrips database, or engage in repeated/systematic extraction of insubstantial parts, whether manually or through automated means (see Section 14).

7. Third-Party Intellectual Property We Use

We may use third-party content, software libraries, and services under license — for example, our reliance on third-party service providers listed in the Privacy Policy (such as Razorpay's checkout interface or Google's Sign-In widget), each of which retains its own intellectual property in its respective product. We do not claim ownership of a third party's intellectual property merely by using or integrating it under license.

8. Open-Source Software

Our Software is built in part using open-source components, consistent with standard software-engineering practice. We have not compiled and do not publish a comprehensive open-source attribution/license notice on the Platform at this time; doing so (an "open-source notices" page listing each dependency and its license) is a standard practice we recommend adopting, particularly where a dependency's license (e.g., certain copyleft licenses) requires attribution.

9. User Content: Ownership and the License You Grant Us

Consistent with the "Ownership of User Content" and "Licence Grant to Onyatrips" clauses of the Terms and Conditions' User-Generated Content module: you retain ownership of your User Content (photos, videos, reviews, messages, itineraries, bios, and similar material you submit). We do not claim ownership of it. By submitting it, you grant us a broad, worldwide, royalty-free license to host, display, reproduce, adapt, and use it to operate, provide, and promote the Platform, including in aggregated, derivative, and anonymized form, for as long as it remains on the Platform (and, after removal, for the limited residual purposes described in that Terms clause, such as backups and content already incorporated into aggregated outputs).

10. Business Content: Ownership and Licensing

A business submitting listing content (descriptions, images, pricing, and other business-listing information under the Business Listing Policy) similarly retains ownership of that content, subject to the same category of license described in Section 9 — we treat business-submitted listing content as a category of User Content for licensing purposes, since the Terms and Conditions do not draw a separate licensing regime for it. A business represents that it owns or has the necessary rights to submit its logo, images, and description, consistent with the warranty standards in the Terms and Conditions' User-Generated Content module.

11. Scope, Duration, and Territory of the Content License

The license described in Sections 9 and 10 is worldwide in territory and continues for as long as the relevant content remains on the Platform. It terminates, for new uses, once you remove the content or delete your account, subject to the residual retention described in the Terms and Conditions (backups/caches for a reasonable period, content already incorporated into an aggregated or anonymized output, and content we are legally required to retain). This mirrors, and does not expand, the license terms already established in the Terms and Conditions.

12. What You May Do With Onyatrips' Content

You may view, use, and interact with the Platform and its Content and Works for your own personal, non-commercial travel-discovery purposes, consistent with the limited access license granted under the Terms and Conditions. Ordinary sharing of a public link to a page on the Platform (for example, sharing a place listing with a friend) is a normal, permitted use.

13. What You May Not Do

Consistent with the "Prohibited Uses and Extraction" clause of the Terms and Conditions' Intellectual Property module, you must not, and must not assist or authorize any person or automated system to: reverse-engineer or decompile our Software or Proprietary Systems; commercially reuse, resell, or redistribute our Content, data, or Onyatrips IP; circumvent a technical access control, rate limit, or security feature; or attempt to derive our scoring, ranking, or matching logic from observing outputs.

14. Scraping, Crawling, and Automated Extraction

Scraping, crawling, spidering, or bulk/automated downloading of the Platform's Content, listings, or data — whether by a simple script or a sophisticated bot — is prohibited, consistent with the Terms and Conditions. This applies regardless of whether the content scraped is otherwise publicly viewable; public visibility for human browsing does not authorize automated bulk extraction.

Edge case — scraped Onyatrips data appearing on a third-party site: if you discover Onyatrips content or data republished elsewhere without authorization, report it using Section 21; we may pursue removal and other remedies against the responsible party.

15. AI Training Restrictions

Consistent with the Terms and Conditions, no license is granted, and none should be inferred from technical accessibility, to use the Platform, its Content, or its data to train, fine-tune, evaluate, or improve any artificial-intelligence or machine-learning model, including through web-scraping by an AI crawler, an LLM training pipeline, or any automated data-aggregation system built for that purpose. This applies to our editorial Content and Works, our datasets, and (subject to the separate license described in Section 9) is without prejudice to whatever license we ourselves may exercise over User Content for our own product purposes, which is a distinct question from a third party's unauthorized use.

Edge case — a User claiming ownership of AI-generated content they uploaded: where a User uploads content they generated using an AI tool (for example, an AI-edited profile photo), they remain responsible for it under the Terms and Conditions' "AI-Generated and Synthetic Content" clause and must have the rights necessary to submit it; this is a question of the User's own warranty to us, distinct from the restriction in this section on third parties using our Platform/data to train their models.

16. API Use and Abuse

Any API we operate or expose may only be used as expressly authorized. Exceeding rate limits, circumventing access controls, or using an API to extract data at a scale beyond ordinary application use is prohibited and may result in access revocation and other enforcement under Section 20.

17. Brand and Trademark Misuse

Using "Onyatrips," "Onya," our logo, or a confusingly similar mark in a way likely to cause confusion, or that falsely suggests sponsorship or affiliation, is prohibited, consistent with Section 3.

18. Domain and Impersonation Abuse

Registering a domain name, social media handle, or app name confusingly similar to "Onyatrips" or "Onya," or otherwise designed to impersonate Onyatrips or divert users from the genuine Platform, is prohibited and may be pursued as trademark infringement, unfair competition, and/or cybersquatting under applicable law.

19. Feedback

If you send us feedback, a suggestion, or an idea about the Platform, consistent with the "Feedback" clause of the Terms and Conditions' Intellectual Property module, you assign to us all rights in that feedback, and we may use it without attribution or compensation to you.

20. Enforcement and Remedies

We may pursue technical measures (blocking, rate-limiting, access revocation), account suspension or termination, and civil or, where applicable, criminal remedies against a confirmed violation of this Policy, consistent with the Terms and Conditions, including under the Copyright Act, 1957, the Trade Marks Act, 1999, and the Information Technology Act, 2000. A breach of this Policy's restrictions on our Proprietary Systems or Confidential Information may cause harm that cannot be adequately remedied with money alone, and we may seek injunctive relief in addition to other remedies, to the extent permitted by applicable law.

21. Reporting Infringement

To report suspected infringement of Onyatrips' intellectual property (for example, a copycat site, unauthorized brand use, or evidence of scraping/AI-training misuse), or to report that your own intellectual property has been infringed by content on the Platform (governed in detail by the Copyright Policy), contact us using the details in Section 23.

22. Changes to This Policy

We may update this Policy as our products, brand, and legal protections evolve. Material changes will be reflected in an updated "Last Updated" date above.
